Privacy Notices in the mail

A very common practice in many companies is to insert a confidentiality notice in their email signatures such as the following:

This e-mail message may contain confidential or legally privileged information and is intended only for the use of the intended recipient(s). Any unauthorized disclosure, dissemination, distribution, copying or the taking of any action in reliance on the information herein is prohibited. E-mails are not secure and cannot be guaranteed to be error free as they can be intercepted, amended, or contain viruses. Anyone who communicates with us by e-mail is deemed to have accepted these risks. Company Name is not responsible for errors or omissions in this message and denies any responsibility for any damage arising from the use of e-mail. Any opinion and other statement contained in this message and any attachment are solely those of the author and do not necessarily represent those of the company.

Este correo electrónico es confidencial y para uso exclusivo de la(s) persona(s) a quien(es) se dirige. The above is NOT USEFUL

The answer is so obvious… We cannot force anyone to do anything by sending an email without accepting something when they have not previously agreed to it, we cannot force them to accept something by simply looking at an email…

Sometimes it is unfortunate that companies use signatures with such strong phrases, but it can be contradictory since the one who revealed the “private” information has everything to lose and not the one who received it. Beware also of phrases such as “The opinions expressed in this email must be confirmed in writing and signed by the sender to be legally valid, so email is not the appropriate medium to issue formal opinions or recommendations.” because an email can be used as evidence in a trial.

What we must include in electronic signatures

The only thing we should include in the signature de nuestro correo en cuestiones legales es un link o un archivo adjunto con nuestro aviso de privacidad y tal vez nuestros términos y condiciones según el giro de la empresa. Es obligatorio que tus clientes o usuarios sepan que es lo que haces con sus datos personales que deben de estar bien definidos en tu aviso de privacidad, pero nadie está obligado a nada con tan solo recibir un correo.
